A married filing joint tax return is just that, a husband and wife combing all of their income, deductions, credits, etc onto a return and signing it. The fact that the wife did not "sign" the return could give her ammunition to dispute the tax return. As far as getting to trouble, you power of attorney is only for your son and not his wife. The tax return (and refund) could be tied up until the IRS receives one that is peoperly "signed" by both spouses. As a spouse on the return, she is entitled to all or part of the refund as the refund check would have both parties' names on it and she has to endorse the check. From that point on, it's tug of war...will she be mature enough and accept half?

A little sugar and honey might go far in convincing her to play ball with you.
